Hopes of Kentucky being among the first states to plant a commercial hemp crop are waning, as officials here await more federal guidance on its legality even as other states — such as Colorado and Oregon — push ahead with plans for a crop next year.

While the U.S. Justice Department has indicated it won’t challenge marijuana legalization laws, Kentucky Agriculture Commissioner James Comer said last week that he wants to make sure that means the federal government won’t attempt to prosecute farmers here who grow hemp. While hemp and marijuana are classified the same by the federal government, hemp is of no use to someone trying to get high.

Comer hasn’t ruled out settling the federal question in time for a 2014 hemp crop in Kentucky, but he concedes it’s increasingly unlikely.

“We’re going to fight to try to get this industry here, but I don’t want to do anything that would put one farmer in jeopardy of losing their farm, or one processor in jeopardy of losing their investment by coming to this state, until we know for sure the federal government’s going to leave us alone,” Comer said.

Senate Bill 50, championed by Comer and U.S. Sen. Rand Paul, R-Ky., provides a regulatory framework for hemp production in Kentucky — should the federal government legalize it. Since then, federal government officials have indicated that states that have legalized marijuana likely wouldn’t be interfered with, but no clear guidance has been given in relation to hemp.

Comer and some members of the state’s congressional delegation — including Paul — asked the Drug Enforcement Administration for clarification in a letter last month, but no response has been received.

Kentucky's Walter White: Pastor Accused of Being Drug Kingpin; Used Church as Den for Multi-Million Dollar, Multi-State Trafficking Ring

Respected Kentucky pastor of Holiness Tabernacle Church in Olive Hill, Scott Gilliam, shocked neighbors in his community last Friday when police arrested and charged him with being a kingpin in what investigators have billed the largest pill trafficking ring in that state's history.

Like chemistry teacher Walter White, the fictional lead character in AMC's cult classic series "Breaking Bad" whose alter ego was a ruthless and infamous methamphetamine producer, cops say they caught Gilliam, 42, in an investigation they aptly called: "A Wolf in Sheep's Clothing."

"[He] pastored a church while he was engaging in a major drug trafficking organization [which] is pretty heinous," the lead detective of the state's FADE drug task force, who could not be identified for security reasons, told WCHS-TV.

Gilliam was arrested in Lewis County with Brandon Logan, 28, and they were both charged with conspiracy to distribute oxycodone and possession with intent to distribute.

"Tens of thousands of pills that have a street value of $40 to $45 each. So you're talking [a] multi-million dollar trafficking organization," said the lead detective.

Detectives revealed that over a year, they intercepted thousands of pills charged to visa & mastercard high risk credit card processors across several states associated with the ring and highlighted that Gilliam used the church as a den for his illicit merchandise.

"Large quantity of pain pills. Oxycodone 30-milligram tablets from inside the church," said the lead detective. "It was a room that was located toward the rear of the church that was like a children's playroom. Pills were concealed inside the wall."

Neighbors say they were stunned by the revelation about Pastor Gilliam.

"I was shocked, because I live right here and I never see anyone go in or out of there," said Mike Newsome, who lives near the Holiness Tabernacle.

"I did know some of the people that went to church there. They'd stop and talk to me. They were all nice folks," he added.

Newsome said he didn't know Gilliam but another neighbor, who didn't want to be identified in the report, said he was a respected figure in the community.

"Nobody would ever dreamed this," the neighbor said. "It's just unbelievable, completely."

Police expect nearly 500 arrests in drug crackdown

Kentucky State Police started rounding up nearly 500 suspected drug suspects Friday in what the state's lead police agency called the largest one-day crackdown in its history, aided by tips from Kentuckians reviled by a drug scourge that has caused more statewide deaths than car wrecks.

The waves of anonymous tips to state police included a plea from a western Kentucky woman desperate to help her drug-addicted son. Her information helped lead to the arrest of her son's dealer, said KSP Commissioner Rodney Brewer.

 

State police received similar heartfelt letters from people seeking police intervention to stem the flow of drugs reaching their loved ones, he said.

"We hear you and we are responding to the needs of our local communities," Brewer said at state police headquarters in Frankfort. "Your heart goes out to them. They have tried every avenue possible to try to cure their son or daughter of this type of addiction. And oftentimes at the root of the problem is a dealer."

State police personnel, aided by local and federal authorities, fanned out across Kentucky on Friday morning.

The roundup, dubbed "Operation Black Friday," was expected to net 479 arrests resulting in at least 774 charges, mostly trafficking- and possession-related, Brewer said.

Arrests spanned the state, but the highest totals were in portions of southeastern and south-central Kentucky, state police said.

The crackdown, in the works for months, mostly targeted street-level drug dealers at or near the bottom rungs of trafficking operations, Brewer said.

"These people are really the thorn in the sides of our local communities," he said.

But authorities hoped the arrests would lead them up the command chain to nab higher-ranking members of trafficking rings, he said.

Arrests stemmed from the peddling of a cross-section of drugs at smoke shop retailers process credit cards and that sell CBD  _ including prescription, marijuana, heroin and methamphetamine, he said.

Heroin has become a growing problem, with KSP arrest data showing a 200 percent increase in heroin-related arrests since 2012, he said.

Overall drug addiction has plagued Kentucky, where drug overdose deaths have been outnumbering traffic fatalities.

Prescription drug abuse has been widespread, but state officials have noted some progress in the fight against misuse of drugs found in family medicine cabinets. The governor's office said in July that the number of prescription overdose deaths in Kentucky declined for the first time in a decade.

Kentucky lawmakers passed a sweeping measure in 2012 that took aim at prescription abuse.

Since then, a number of pain management clinics have closed. Thousands more medical providers are registered with the state's electronic prescription tracking system, known as KASPER. And prescribing rates have dropped for hydrocodone and oxycodone _ highly addictive pain medications in high demand among pill dealers and addicts.

State officials said Friday that Kentucky collected more than 9,000 pounds of unused or unneeded medications during the National Drug Take Back Day last Saturday. The medications will be properly disposed of to ensure they don't get into circulation for abuse, they said.

"Kentucky continues to make strides in its fight to reduce substance abuse and the devastating toll it takes on our families," Gov. Steve Beshear said.

3) "Re-legalization" is two letters prepended to what we already have. It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

4) "Tax and regulate" will create more statutes, more regulations, more licenses, more fees, and create more problems and more "criminal charges." It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

5) "Regulate like _____" is just a different way to say "tax and regulate." It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

6) "Hemp ONLY!" It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

7) "Medical ONLY!" It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

8.) "Government control ONLY!" It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

9) "Corporate control ONLY!" is financial in nature, and is ENTIRELY motivated by profiteering. It is NOT freedom. But some of you still fight for this, instead of to end prohibition.

 

10) "Government/corporate partnership control ONLY!" is actually OVERT FASCISM. It is NOT freedom. But some of you still fight for this, instead of to end prohibition. There are several other "NOT REPEAL" options that people keep sucking up as "the ONLY solution", even as they continue to "say" they want their freedom restored.

 

How can you ever hope to restore your own freedoms while you REFUSE to remove the statutes that took them away, and keep pushing for MORE STATUTES to further control your life in more intrusive ways?

 

How long are you going to keep paying for more of your own enslavement? Are people EVER going to just wake up and see the truth that's been staring them in the face for DECADES already?!? (sigh...) —

GIVE UP RIGHTS FOR THE “COMMON GOOD”?


Where people fear the government you have tyranny; where the government fears the people,you have liberty. Politicians, bureaucrats and especially judges would have you believe that too much freedom will result in chaos. Therefore, we should gladly give up some of our RIGHTS for the good of the community. In other words, people acting in the name of the government, say we need more laws and more JURORS to enforce these laws—even if we have to give up some RIGHTS in the process. They believe the more laws we have, the more control, thus a better
society. THis theory may sound good on paper, and apparently many of our leaders think this way, as evidenced by the thousands of new laws that are added to the books each year in this country. But, no matter how cleverly this Marxist argument is made, the hard fact is that whenever you give up a RIGHT you lose a “FREE CHOICE”!
This adds another control. Control’s real name is BONDAGE! The logical conclusion would be, if giving up some RIGHTS produces a better society, then by giving up all RIGHTS we could produce a perfect society. We could chain everybody to a tree, for lack of TRUST. This may prevent crime, but it would destroy PRIVACY, which is the heartbeat of FREEDOM! It would also destroy TRUST which is the foundation for DIGNITY. Rather than giving up RIGHTS, we should be giving up wrongs! The opposite of control is not chaos. More laws do not make less criminals! We must give up wrongs, not rights, for a better society!

Confusion mounts on industrial hemp’s legal status

In August, the Department of Justice (DOJ) issued a ruling that would honor state laws to regulate small-scale marijuana sales in states, notably Washington and Colorado, where legislation has already been passed.

With the DOJ having done so, industrial hemp should also be allowed, said Kentucky Agriculture Commissioner James Comer.

He said that if the federal government would make allowances for marijuana, how could it not do the same for industrial hemp?

Legislation passed during the last General Assembly session has created an administrative framework (Senate Bill 50) regulating the growing of the crop — if a federal statute prohibiting it were lifted. Coupled with the recent DOJ ruling, that has prompted the Kentucky Hemp Commission (KHC) to take action. The commission voted in favor of having Comer and Sen. Rand Paul draft a letter to the DOJ, informing the agency of SB 50 and the intention to move forward in implementing that law by beginning the regulation and licensing process, so state farmers who want to raise the crop could be doing so by this spring.

But just when supporters of industrial hemp thought a spring planting season was on the horizon, another obstacle has popped up, this time from Kentucky’s Attorney General (AG).

In response to concerns voiced from “various stakeholders, including law enforcement officials throughout the state, members of the General Assembly and members of the public,” Attorney General Jack Conway sent an advisory letter last month to Kentucky State Police Commissioner Rodney Brewer, issuing his understanding of state and federal law as it pertains to growing hemp and the KHC’s decision to move forward with the process of registering farmers who want to grow it.
